U.S. Federal Court of Appeals upholds the Morgan v. Hennigan decision.

In a unanimous opinion written by Judge Frank Coffin, the court finds, “It is beyond dispute that the defendants took every opportunity to maintain segregation where it existed and to foster segregation where it did not. To use the Supreme Court’s language, the neighborhood school concept has not been maintained free of manipulation.” The Supreme Court allows the decision to stand by refusing to hear an appeal of the case on May 12, 1975.
